Terms of Service

Welcome to Threshold. These Terms of Service (“Terms”) govern your access to and use of the Threshold iOS app and the website at thethresholdapp.com (together, the “Service”), operated by Athlete Mindset Inc. (“we,” “us,” “Threshold”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (16 in the European Economic Area and the United Kingdom) to use the Service. If you are under 18, you must have a parent or guardian's permission. By using the Service, you represent that you meet these requirements and that you have the legal capacity to enter into these Terms.
2. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at threshold@athletemindset.app if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.
3. Subscriptions, free trial, and billing
Free trial
New subscribers receive a 7-day free trial. No payment is taken during the trial. If you do not cancel before the trial ends, your paid subscription begins automatically and your payment method is charged.
Subscription plans and pricing
Threshold offers the following auto-renewable subscription plans:
- Monthly: US$14.99 per month, billed monthly.
- Annual: US$99.99 per year, billed yearly (an effective rate of US$8.33 per month).
Prices may vary by region and are shown in your local currency at the point of purchase. Applicable taxes are added where required by law.
Auto-renewal
Your subscription automatically renews at the end of each billing period at the then-current price unless you cancel at least 24 hours before the renewal date. Your payment method will be charged within 24 hours before the end of the current period.
How to cancel
iOS subscriptions: manage and cancel in iOS Settings → your Apple ID → Subscriptions → Threshold. Cancellation takes effect at the end of the current billing period; you keep access until then.
Web subscriptions: sign in at thethresholdapp.com and open Profile → Manage Subscription.
Refunds
Refunds for iOS subscriptions are handled by Apple under Apple's standard refund policy; request one at reportaproblem.apple.com. For web subscriptions, contact threshold@athletemindset.app within 14 days of the charge. Beyond those windows, fees are non-refundable except where required by law.
Promotional codes
Promo codes and free access codes are non-transferable, have no cash value, and may be restricted in duration or scope. We may revoke codes obtained through fraud or in violation of these Terms.
4. Medical disclaimer — not a substitute for professional advice
Threshold provides training plans and coaching suggestions for informational and educational purposes only. It is not medical advice, physical therapy, or a substitute for consultation with a qualified healthcare professional, licensed coach, or sports physician.
Consult your physician before beginning any exercise program, especially if you have a pre-existing condition, are recovering from injury or illness, are pregnant, or have been sedentary for an extended period. Stop exercising immediately and seek medical attention if you experience dizziness, chest pain, shortness of breath, or any other symptom that concerns you.
Running and endurance training carry inherent risks, including injury. You assume full responsibility for decisions about when, how, and whether to train. You use the Service at your own risk.
5. License and acceptable use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial training. You agree not to:
- copy, modify, reverse engineer, or create derivative works from any part of the Service;
- resell, sublicense, or commercially exploit the Service or its content;
- use automated means (bots, scrapers, crawlers) to access the Service or extract data;
- interfere with the Service's operation, security, or other users;
- upload content that is illegal, harmful, harassing, infringing, or otherwise objectionable;
- use the Service in violation of any applicable law or regulation.
6. User content
When you share information with the Service — such as chat messages, onboarding answers, or workout notes — you grant us a worldwide, royalty-free license to process that content solely to operate, improve, and provide the Service to you. You retain ownership of your content. You represent that you have the right to submit the content you share.
7. Intellectual property
The Service, including its software, design, copy, training methodology, and knowledge base, is owned by Athlete Mindset Inc. and its licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms transfers any intellectual property rights to you except the limited license described in Section 5.
8. Third-party services
The Service integrates with third-party services including Apple HealthKit, Apple App Store, Stripe, Supabase, Anthropic, OpenAI, Tavily, and Vercel. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the acts, omissions, or policies of third parties.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THAT TRAINING PLANS OR COACH SUGGESTIONS WILL PRODUCE ANY PARTICULAR OUTCOME OR IMPROVEMENT IN FITNESS OR PERFORMANCE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATHLETE MINDSET INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US DURING THAT PERIOD, OR (B) US$100.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability for consequential or incidental damages, so some of the above may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Athlete Mindset Inc. from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party right.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately, without notice, if you violate these Terms or if your account is used to harm us, other users, or third parties. Sections that by their nature should survive termination (including 6–14) will survive.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will notify you through the Service or by email and update the “Last updated” date at the top of this page. Continued use of the Service after the change means you accept the updated Terms.
14. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. If you live in a jurisdiction whose laws grant you non-waivable rights, those rights are unaffected by this section.
